Who these terms cover
These Terms and Conditions apply to the public website at kiwinove.co.nz and the free tools made available by Kiwinove IT Solutions Limited (Kiwinove, we, us or our). “You” means the person using the website or a tool, and an organisation you are authorised to act for where applicable.
They do not replace an agreed proposal, managed services agreement, statement of work or other contract for paid services. Those services are governed by the agreement made for them. Merely using a free tool does not create a managed services, monitoring, support or professional advisory engagement.
Using the free tools
Please read these terms before using a tool. By choosing to use a free tool after these terms have been brought to your attention and made available to you, you agree to use it on this basis, subject always to the legal rights described in section 8. If you do not agree, do not use the free tools.
Important limitations are also displayed on individual tool pages. Read them together with these terms. The summary on this page is a guide, not a substitute for the full terms. No wording here requires you to give up a right that cannot lawfully be excluded.
What the tools can and cannot do
The tools are free, self-service utilities supplied on an “as is” and “as available” basis, to the extent permitted by applicable law. We aim to make them helpful, but do not promise uninterrupted access, error-free operation, complete or current information, or suitability for your particular circumstances.
- Speed tests and connection details are observations for a device, connection and point in time. Wi-Fi, congestion, VPNs, proxies and the test provider can affect results. They are not proof that an internet provider has met or breached its contract.
- DNS, email and website checks inspect a limited set of public information. A healthy result is not a certification of security or compliance; a warning is not proof of a vulnerability, compromise or misconfiguration. Some records, including DKIM selectors, cannot always be discovered.
- Password checks and generators do not guarantee that a password cannot be guessed, stolen or compromised. Device security, password reuse, phishing and multi-factor authentication remain important.
- Email header analysis and readiness assessments depend on supplied information. They do not establish the authenticity of a message, tenant configuration, regulatory compliance or readiness for every business requirement.
- QR codes and email signatures must be tested before use, distribution or printing. Devices and email applications may handle content differently. Linked services and external images can change, become unavailable or be blocked.
- Image resizing and compression process a copy in your browser; keep the original. Results may change quality, colour, transparency, metadata or dimensions. A KB/MB limit is a target, not a guarantee of exact size, visual quality or acceptance by another service. Dimensions may be reduced if you allow it. Supported formats and processing depend on browser and device limits. Check the result and your rights to use and share it. This is not a certified metadata-removal, redaction or secure-deletion tool.
- PDF merging and splitting create new documents on your device. Keep the originals and verify page order, rotation and content. Advanced features, bookmarks, accessibility information and metadata may not be preserved; encrypted, signed and interactive-form PDFs are not supported. This is not a sanitisation or redaction tool.
- Image-to-text recognition (OCR) processes images and selected PDF pages on your device. Recognition can misread or omit content, especially names, numbers, handwriting and complex layouts. Large pages may be scaled down. Review extracted text against the original before relying on it. Downloads are plain text, not searchable PDFs. Browser and device limits apply.
Reports, scores, downloads and generated content are not legal, financial or other regulated advice. Do not use a result alone to make a security-critical or otherwise significant decision. Obtain appropriate professional advice where needed.
Your responsibilities
You are responsible for checking your inputs, verifying results independently, testing generated content and deciding whether and how to use it. Before making changes to systems, DNS, accounts or data, take appropriate backups, obtain permission and consider the effects on your organisation.
Use only information, systems, images and content you are entitled to use. Do not use our tools to gain unauthorised access, harass others, distribute malicious content, impersonate someone, breach intellectual property rights or interfere with any service. Do not bypass safeguards or run automated, bulk or excessive requests that could harm the website or third parties.
Providing a public checker is not permission to perform intrusive testing, scan private infrastructure or access another person's information. Never submit access tokens, recovery codes or other secrets to a public lookup. Use dummy information when testing or demonstrating a tool where possible.
Third-party services
Some tools depend on external networks, public DNS resolvers, hosting services, websites or applications. Their data, processing, availability and behaviour are outside our control. For example, connectivity and DNS tools use Cloudflare services, external logo previews contact the image host, and email applications control how pasted signatures are displayed.
Third parties may have their own terms, charges and privacy practices. We do not guarantee their services or endorse every destination linked or encoded by a user. To the extent permitted by law, Kiwinove is not responsible for failures or changes in independent third-party services. This does not remove any responsibility the law places on us for our own conduct.
Privacy and your content
Read our Privacy Policy and the privacy explanation on each tool. Browser-only processing does not mean every tool works without network traffic. Hosting providers and external services may process technical information and operational logs.
Kiwinove does not maintain a tool-input history or a database of generated reports. A download remains on your device; copied content may remain in clipboard history or sync to your other devices. Reports may contain public IPs, domains or business information. QR codes may disclose Wi-Fi credentials. Signatures may disclose contact details and reference external images.
You decide what to enter, download, copy or share and with whom. Keep confidential content secure, especially on shared devices. Results are not automatically sent to Kiwinove; if you choose to send them to us, the Privacy Policy applies to that communication.
Limits of liability for free tools
This section is subject to section 8 and applies only to the website and free tools, not to separately contracted paid services.
To the fullest extent permitted by applicable law, Kiwinove excludes warranties, representations and conditions that might otherwise be implied in relation to the free tools, including as to accuracy, completeness, availability and fitness for a particular purpose.
To that same extent, Kiwinove excludes liability arising from your use of, inability to use or reliance on the free tools, website information or generated results. This includes loss arising from inaccurate or incomplete outputs, decisions or system changes based on them, loss or corruption of data, business interruption, lost revenue or profits, and indirect or consequential loss.
These exclusions do not apply to the extent the law prohibits them. In particular, they do not exclude liability for fraud or wilful misconduct, or any other liability that cannot lawfully be excluded. Nothing on this page is a promise that a dispute cannot arise or a restriction on a lawful right to seek a remedy.
Rights we cannot exclude
Nothing in these terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified. This includes rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986 where applicable, and any other mandatory protections that apply to you.
We do not assume those rights disappear simply because a tool is free, you use it for business or you accept these terms. These website terms do not attempt to contract out of those Acts for business transactions. If a limitation conflicts with a mandatory legal right, that right prevails to the extent of the conflict.
Ownership and permitted reuse
The Kiwinove name, branding and website materials belong to Kiwinove or their respective owners. You may use the tools for legitimate personal and business purposes. You may use and share the reports, passwords, QR codes and signatures you generate, subject to the rights of others and these terms.
You retain rights in your own supplied content. We do not claim ownership of it merely because it passes through a tool. You must have permission to use a logo, image or other third-party material. Do not present a result as a Kiwinove certification, independent audit or endorsement, or misleadingly alter a report. Third-party and open-source licences continue to apply where relevant.
Availability and changes
Free tools may be updated, suspended or withdrawn for maintenance, security, abuse prevention or other operational reasons. They have no promised service level, response time or ongoing support commitment unless we separately agree one with you. Where reasonably practicable, we will communicate material changes that affect continued use.
We may update these terms by publishing a new version and date. Material changes will be brought to users' attention on the affected tool pages before further use. Changes apply prospectively; they do not retrospectively remove rights that have already arisen. If you do not agree with updated terms, stop using the affected tools.
Questions and disputes
If something appears wrong, please contact us with the tool name, what happened and non-sensitive details that help reproduce it. We welcome good-faith reports and will consider concerns reasonably. Reporting an issue does not guarantee a particular response time or outcome.
These terms are governed by New Zealand law, subject to any mandatory law that applies to you. New Zealand courts have non-exclusive jurisdiction. Nothing requires you to waive access to a tribunal, regulator, court or other remedy available by law, or prevents urgent action where appropriate.
If a provision is unlawful or unenforceable, it applies only to the extent permitted; the remaining provisions continue where they can lawfully do so.
